United Parcel Service Inc. and a deaf package handler in Minnesota have settled his failure-to-promote and failure-to-accommodate lawsuit, federal court records show.
Jeffrey Pagenkopf claimed he was denied a driver position by the package delivery giant despite proposing multiple accommodations that would have helped him perform the essential job function of communicating. Pagenkopf has been profoundly deaf since birth and communicates via American Sign Language and written notes. His proposed accommodations included voice-to-text/text-to-voice apps, a pre-recorded message for customers, leaving a note for customers to call to schedule a future delivery, video-relay interpreting technology, and video-relay phone service.
